Service Terms & Conditions:
We offer waste and recycling collection services in accordance with these Terms and conditions. A Service Agreement, duly signed by both parties, takes precedence in all instances.
Delivery Your Bin:
We deliver bins according to the timeline set post-order confirmation.
Scheduled Collection Day: We are dedicated to emptying your bin on the scheduled collection day. If there are any changes to this schedule, we will inform you in advance via email or text. Our services are available 365 days a year, including public holidays. However, please be aware that collection schedules on public holidays may vary.
Exclusions: We do not collect hazardous, toxic, biochemical, flammable or harmful in any way including any substance which is prohibited from being collected, stored or disposed of pursuant to any statutes or regulations.
Unforeseen Circumstances: If circumstances beyond our control prevent us from fulfilling our obligations to you under the service agreement, we will not be liable.
Recycling Integrity: We commit to processing all waste that you intend to recycle and to not processing any ” bona fide” recycling material as a landfill.
Weight Limit: Pricing is based on waste not exceeding 125 kg per cubic meter. Excessive weight will result in extra bin charges at the discretion of Rubbish Direct.
Price and Payment:
Quotations: All quotations given by us are based on current rates of labour, overheads, materials, insurance, and current quotations from suppliers. We reserve our right to add any increases in the price of these items or services and any other costs incurred by us occurring after the date of quotation to the quotation price.
Price Increase: Limited to one increase annually, excluding government levies and surcharges.
Prompt Payment Discount: A prompt payment discount of 5% shall be applied to an account invoice if payment is made on or before the due date (Due Date is the 20th of the month following invoice).
Credit Terms: If credit has been extended by us to you, payment is due on or before the 20th day of the month following the month in which the invoice is issued by us. If we at any time deem your credit to be unsatisfactory, we may immediately terminate this Service Agreement or any credit arrangement and require you to pay the price on delivery of the services.
Late Payments: We may charge interest on any overdue monies from the due date (the 20th month following invoice) until the date of actual payment. The interest rate you agree to pay is 0.1% per day on all overdue monies.
Recovery Costs: You agree to pay on demand all reasonable costs (including commission and legal fees as between solicitor and own client and any other costs) incurred by us or our agents relating to the recovery of any amounts payable by you to us.
Prices: Unless otherwise stated all prices exclude GST and other taxes and duties, which, if payable, are payable by you.
Notice Period: Service agreement can be terminated by either party giving 60 days written notice prior to the expiry of the current term.
Performance Failure: If we fail to provide the services described in this Service Agreement in a satisfactory manner, and we do not correct the issue within fourteen working days after receiving written notice from you, you may terminate this Service Agreement.
Termination Fee: If Rubbish Direct is providing the services described in the agreement signed by both parties in the agreed manner and the customer attempts to cancel this Agreement without agreed cause before the expiration of its term Rubbish Direct Ltd may elect (in its sole discretion) to charge the customer the following amount as pre-estimated liquidated damages:
- Early Termination Fee will be calculated using the average monthly billing for the preceding six-month period, multiplied by six or by the number of months left till the expiration of the term of this agreement, whichever is less.
- If the Customer has been serviced for less than six months an amount equal to the average monthly billings for the months during which the Customer has been serviced (if none, then the amount of billings projected by Rubbish Direct Ltd), multiplied by six or the remainder months before expiration of this agreement, whichever is less.
- To claim for any additional losses suffered by Rubbish Direct Ltd.
No Refunds for Rendered Services: Services once provided are non-refundable.
Cancellation Refunds: In the event of service cancellation, if you have made any advance payments, we will process a refund. However, this refund will be subject to the deduction of relevant fees and costs as outlined in our service agreement.
Using and Looking After Your Bin:
Ownership (both legal and equitable) in all equipment delivered to you remains at all times with us. You agree that you will maintain the equipment in a fit and proper manner while it is in your possession and that you will ensure that it is not used for the storage of excluded rubbish/waste. If any equipment is lost, stolen or damaged (other than fair wear and tear) we reserve the right to charge you for the cost of repair or replacement of the equipment.
You agree ownership in all rubbish and recycling will vest in us at the point in time that the rubbish and recycling is collected by us from you. Title to ownership (both legal and equitable) to excluded waste will at all times remain with you, even if collected by us.
We can remove the following types of inorganic garbage
- Large Appliances
- Small Appliances
- Sporting Items
- Outdoor Items
If your inorganic item is not included above, contact us and we will figure something out.
Commingled Recycling Bins:
You can put the following loosely into our recycling bins, remember – NO plastic bags:
- Glass bottles
- Cans and tins
- Milk Bottles
- Plastic containers and tetra packs
- Disposable coffee cups
- Glass jars
Food Waste Bins: You can dispose of the following:
- Vegetables & fruits.
- Meat & seafood (including bones and shells).
- Coffee cups.
- Biodegradable packaging.
- Paper towels & napkins.
- PLA grade bottles and food containers.
Skin Bin Hire:
The following type of waste should not be disposed into the Skip Bin
- Large quantities of clean fill, hardfill and soil
- Asbestos and other toxic materials
- Gas bottles
- Car or lithium batteries
- Liquids and paint.
- Fridges or freezers unless degassed
- Chemicals and hazardous items
- Polystyrene (modest amounts allowed)
You are responsible for any damage to our bins beyond normal wear and tear while they are in your possession. Additionally, you will bear liability for any costs or obligations we incur due to your non-compliance with these terms.
Changes to Terms: We may occasionally update these terms to align with our evolving services. If changes are made that affect your service agreement, we will directly notify you via email. By continuing to use our services after receiving this email, you agree to the updated terms.
Changes to Charges: Our service prices are subject to change. If there is a price adjustment affecting your services, you will be notified individually through email.
Changes to Services: Our services may undergo modifications as needed. If any change impacts your current services, we will inform you via a personalized email.
Privacy and your personal information:
Rubbish Direct collects personal information about you through your use of the Services, including:
Your registration details and information relating to your use of the Website and the content you access.
You agree that Rubbish Direct may use this personal information to assist us in providing the Services to you, for internal research purposes, to verify your identity, for promoting and marketing other Rubbish Direct products and Services to you, and for any other use you authorise.
Changes to this Terms & Conditions
We reserve the right to make changes to this Terms & Conditions.
